Off-shore Partner visa to Australia subclass 309 / 100

This visa is for the spouse or de facto partner of an Australian citizen, permanent resident or eligible New Zealand citizen planning to apply while outside Australia. A Spouse Visa may be suitable for you if you are currently in a relationship with an Australian citizen or Australian permanent resident, or an eligible New Zealand citizen and hope to live in Australia with your partner.

To be eligible, all applicants must prove that their relationship is genuine and continuing. Financial commitment, social acceptance, emotional support and the nature of the household are ways of demonstrating this. Applicants in a long-term relationship will often receive their visa approvals for the 309 and 100 simultaneously.

1. Partner/Spouse Visa (Temporary) Subclass 309

300 Fiance – Prospective marriage visa

The Prospective Marriage Visa (Subclass 300) allows you to entry to Australia to marry your fiance and permanently stay in Australia.

You must prove that your relationship is genuine and continuing. Financial commitment, social acceptance, emotional support and the nature of the household are ways of demonstrating this.

Apply for a 300 Visa

To be eligible to apply for a 300 Fiance Visa, you must:

Temporary & Permanent Contributory Parent visa 174 & 143

Suppose your child or children have become Australian citizens, permanent residents, or eligible citizens of New Zealand. Now, you wish to join them. In that case, you will need to apply for a Parent visa.
Temporary & Permanent Parent visa is for people who have a child living in Australia. A child who will be a family sponsor must be an Australian citizen, permanent resident, or eligible New Zealand citizen. Parent visa requires a family balance test.

A contributory parent visa means you pay for your parents to move quicker in a visa application queue:

Visa types

Subclass 143 – This permanent visa is called a “Contributory” visa. This is because the initial application fee is $4,225 for the first applicant and $1,425 for a spouse. However, the second instalment for each applicant is $43,600. This visa takes approximately 5.7 years to process and is a permanent visa from approval.

The significant “Contribution” of money that is called for upon the second instalment is to offset the rights that are awarded to the visa holder under permanent residencies, such as health care that they have not contributed towards throughout their lives as ordinary Australians have throughout their life by way of tax.

Subclass 173 – This is a temporary visa with an initial Australian government fee of $2,850 and $1,425 for spouses. Before the visa is granted, the second instalment of $29,130 is required to be paid. This visa takes approximately 4.7 years to process. The applicants are granted a 2-year temporary visa. Before this visa expires, they must pay an additional $19,420 and apply for the permanent visa subclass 143.

In all cases, the second instalment of monies paid is only called for after each applicant has passed health and character tests and the AoS (Assurance of Support, see below for AoS details) has been lodged with the Australian government. No second instalment will be paid and a visa not granted.  Second instalments are non-refundable in all cases.

The Australian Government only issues a limited number of family visas per year. It means that any parent visa application gets a place in a queue. Your child or one of your children will need to be your sponsor. To sponsor your visa, your child must meet the eligibility criteria.

An adopted child, child visa or orphaned relative 101 & 802

You can apply for a Child visa to Australia in a few very different situations. Suppose one parent of a child is an Australian or an eligible New Zealand citizen. In that case, the child is automatically an Australian citizen. But if you migrate or migrate with a child, you may have to apply for a Child visa. New Zealand Citizen Family Relationship Visa (Subclass 461) (Temporary)

If you are not a New Zealand citizen but have a family member who is a New Zealand citizen who either has or is eligible to apply for a Special Category visa (subclass 444), you may be eligible to apply for the New Zealand Citizen Family Relationship visa. This five-year temporary visa allows non-New Zealand citizens, such as de-factor partners or spouses, to live and work in Australia while they remain in a de-factor relationship with their New Zealand partner. Last remaining relative, aged relative and carer
Relative visas allow family members to immigrate to Australia. You may sponsor a family member if you are an Australian citizen, permanent resident, or New Zealander. Usually, it is a temporary visa first, leading to permanent residency and citizenship.

Three of the main subtypes of Australian Relative Visa include:

• Remaining relative visa – This relates to people who are the only relative left outside Australia.

You must also be sponsored by a family member or their partner who never sponsored someone else that had one of the following visas or held this visa themselves:

• Remaining relative visa – subclass 835.
• Preferential family visa – subclass 104.
• Family visa – subclass 806.

You are eligible to apply for a relative visa if:

• You are sponsored by an eligible parent, step-parent, sibling or step-sibling who is over 18.
• Your sponsor is an Australian citizen, a permanent resident, or an eligible New Zealand citizen.
• You or your partner don’t have a near relative who lives out of Australia.
• You and your partner don’t have a near relative in Australia under a temporary visa or staying illegally; temporary visas include bridging visas
• You have an assurance of support.

• Carer visa – A carer visa applies to anyone with a relative in Australia who requires ongoing care. The person’s mental or physical condition in question must be likely to continue for at least two years to be eligible.

• Subclass 116 and
• Subclass 836

You meet the eligibility requirements for a carer visa if:

• You are sponsored by a relative or your relative’s family member who requires care.
• You are capable of providing adequate care for your relative.
• You hold a substantive visa except for a transit visa 771 (required for a subclass 836).
• You had a valid visa and made an application for subclass 836 within a permissible timeframe (only for 836 visa applications).

• Aged dependent relative visa – This visa allows elderly relatives outside Australia to reunite with their families. They must have received direct financial support from an Australian citizen or permanent resident for at least two years prior.

The eligibility requirements for an aged dependent visa are as follows:

• You must have an acceptable sponsor.
• You must be of pension age (between 65-67).
• You must be genuinely dependent on your sponsor.
• You must be single.
• You must have assurance of support.
