Formal advice from the Australian Immigration Department has been released today in relation to visa holders who remain onshore and cannot leave Australia due to travel restrictions:

Travelling from overseas
All people entering Australia must self-isolate for 14 days.
You may board a domestic flight to your intended destination in Australia to self-isolate there.
If you are well and not symptomatic, you may self-isolate in a hotel.
If travellers do not comply with their 14 day self-isolation requirements, they may face a range of penalties that exist in each State or Territory.

Exemptions to travel restrictions

You can travel to Australia if you are:

  • an Australian citizen
  • a permanent resident
  • a New Zealand citizen usually resident in Australia
  • an immediate family member of an Australian citizen or permanent resident or are a New Zealand citizen usually resident in Australia.

Travellers who have a compassionate or compelling reason to travel to Australia can use this form to apply for an exemption.

What impact can the COVID-19 have on your visa?

I’m sure you’re currently being bombarded with emails, social media posts and TV adverts with random information & facts relating to this pandemic like we all are. Every second night there is live press conferences and new announcements on what else is changing in our day to day lives, but have we gotten any information on the detrimental effects this will have for students, tourists and temporary residents in Australia?

Piotr Ferenc, our migration agent has provided the following advice to applicants in this situation –

ATTENTION ONSHORE CLIENTS –

Flights/Travel –

  • ALL travelers to Australia are required to self-isolate for a minimum of 14 days, either at home or a hotel if you are not symptomatic.
  • ONLY Australian Citizens, Permanent Residents and New Zealand Citizens who reside in AU are allowed entry to Australia.
  • You are required to show evidence of your Australian Citizenship OR Permanent Residence. If you are a New Zealand Citizen who resides in AU, then you’re required to evidence your residency (e.g. AU driver’s license) when checking in at airports.

General –

  • Applicants who hold temporary visas located in Australia are obligated to apply for a new visa prior to their visa expiry.
  • There are NO exemptions when it comes to respecting Australian Migration Law in a crisis like this.
  • You are to remain lawful, and ensure you are complying with your visa conditions at all times.

Conditions & Solutions –

  • In many cases, a visitor visa or medical treatment visa might be an appropriate short-term solution for people who are unable to return home due to the travel restrictions or medical conditions.
  • Some visas may have conditions imposed, restricting visa renewal in Australia. Check if your visa has any of the following condition codes – 8503, 8534 or 8535 listed. If so contact us to discuss applying for a condition waiver.
  • If your visa has the condition code 8558, it means you cannot stay in Australia longer than 12 months within any 18 months period.  If this applies to you, please let us know prior to reaching the 12 months limit, so we can arrange a new visa for you.
