Kimberley Designated Area Migration Agreement (Kimberley DAMA)

The priority for the EKCCI is always to promote jobs for Australians first. However, the EKCCI and East Kimberley industry have highlighted the need for improved access to overseas workers on a sustainable basis where occupations and positions are not able to be filled from the Australian labour market.

The Kimberley DAMA is an agreement between the EKCCI and the Federal Government that allows employers operating in the Kimberley region to access a broader range of occupations than standard skilled migration avenues, and with numerous concessions including experience, age, and in some cases salary and English, among others. These arrangements help employers attract and retain the right people to our region on a sustainable basis, where they have not been able to fill positions from the Australian labour market.

The Kimberley DAMA Designated Area aligns with the Local Government Area of the Shire of Wyndham East-Kimberley, The Shire of Broome, The Shire of Halls Creek, and The Shire of Derby-West Kimberley. Employers requesting endorsement must have operations in the Designated Area, and the position/s being sought must be located within the operations of the employer within the Designated area.

The Kimberley DAMA is accessible to all employers operating in the Kimberley region and is not exclusive to EKCCI members.

South West DAMA

The South-West region has entered into a Designated Area Migration Agreement (DAMA) with the Commonwealth as a way to address the current skills shortages affecting the region.

The South West DAMA was signed in December 2021 and took effect from January 2022.  An updated agreement with an expanded list of occupations was signed and took effect in August 2024.

It is accessible for businesses operating within the designated South-West region that have advertised but been unable to source skilled workers locally to fill nominated positions within their workforce. Under the terms of a DAMA, businesses operating within the South-West area may be able to access a broader range of occupations as well as concessions not generally available through the standard skilled visa programs.

Employers who have an interest in accessing the DAMA are required to first submit an application to the Shire of Dardanup, who are the appointed Designated Area Representative (DAR) for the South-West DAMA. A positive endorsement then allows you to request a Labour Agreement with the Department of Home Affairs.

Businesses operating within the following local government areas will be eligible to apply for endorsement to access the DAMA and apply for a South-West DAMA Labour Agreement with the Department of Home Affairs:

Far North Queensland Designated Area Migration Agreement (FNQ DAMA) (effective from 19 December 2023)

About the FNQ DAMA
The FNQ DAMA is a skilled migration program that is tailored to the needs of our Far North Queensland region (FNQ). The FNQ DAMA differs in many ways from standard skilled migration pathways, providing more flexibility and certainty for both employers and workers. The key differences are*:

An FNQ DAMA Occupation and Concessions List designed for our region, with a greater range of occupations not linked to standard occupation lists, and with no caveats;
The ability to have occupations added (or removed) as local demands determine;
Semi-skilled as well as skilled occupations (Skill Levels 1-5 instead of Skill Levels 1-3);
The facility to design and include unique local occupations not in ANZSCO (the standard classification of occupations);
Access to age concessions of 55 or 50 (depending on occupation) rather than the general age limit of 45 applying to most standard skilled migration pathways;
Multiple visa options – SID 482, ENS 186, or SESR 494 (that leads to PESR 191);
Access to well-defined permanent visa pathways for all occupations in Skill Levels 1-5 (including direct access to ENS 186 in some circumstances based on prior work experience in FNQ);
Concessions to experience requirements, compared to those in standard skilled migration pathways;
Salary concessions for Skill Level 3-5 occupations (90% of TSMIT) if market salary is demonstrated to be below TSMIT, ensuring that worker terms and conditions of employment are not eroded;
English language concessions for numerous occupations;
More lenient Labour Market Testing requirements than standard requirements;

The FNQ DAMA operates under a Labour Agreement framework. This means that employers can seek one occupation/position or multiple occupations and positions in a single agreement. It also means that prospective workers do not necessarily need to have been identified at time of applying, allowing for future planning. Individuals can then be nominated against the occupations and numbers of positions in the Labour Agreement. A Labour Agreement is generally valid for five years and can be varied during its lifetime (such as adding further occupations/positions).

As with all skilled migration, the priority is employment for Australians first. However, the FNQ DAMA provides a tailored and accessible option for employers seeking to fill one or multiple occupations and positions where they are genuinely unable to fill positions from the Australian labour market.

  • Concessions to work experience requirements, compared to those in standard skilled migration pathways;
  • Salary concessions for lower skilled occupations;
  • English language concessions for numerous occupations;
  • The Goulburn Valley region, in Northern Victoria, entered into a DAMA with the Australian Government in December 2021. This includes the Local Government areas of Greater Shepparton City Council, Moira Shire Council and Campaspe Shire Council.The GV DAMA enables the region’s employers to sponsor skilled and semi-skilled overseas workers for specified occupations they are unable to fill with local workers.

    The DAMA program utilises the subclass 482 Temporary Skills Shortage (TSS), subclass 494 Skilled Employer Sponsored Regional (Provisional), and subclass 186 Employer Nominated Scheme (ENS) visa programs.

What is the RDA Orana DAMA

The Regional Development Australia Orana Designated Area Migration Agreement, or RDA Orana DAMA, is a five-year, employer-sponsored visa program agreement between the Regional Development Australia Orana (RDA Orana) region and the Australian Government.

It gives local employers a way to bring onboard overseas workers who are highly skilled in specified industries.

The RDA Orana DAMA isn’t about promoting migrant employment instead of local employment. In fact, RDA Orana strongly encourages employers to offer positions to Australians first wherever possible. The RDA Orana DAMA is simply there to supplement the local workforce in response to the skills shortages in the area.

While there are other paths available to address these skill shortages, such as training and education programs, these options are often nowhere near fast enough. One of the key benefits of having a strong temporary skilled migrant program within Australia is how quickly and efficiently we can respond to these labour and skill shortages.

It can take Australians years to achieve the same qualifications that overseas workers already hold. In the meantime, temporary skilled workers can offer high-quality and highly relevant expertise immediately.
