Yes, you can lodge the 482 TSS visa even if you are offshore – this just means you must wait offshore until the decision on the application is received.
SAF Levy was introduced to immigration last year, this is a fund which contributes to the training of Australian Citizens & Permanent Residents whilst hiring foreign employees. This is a required fee to be paid by sponsors only.
Once your 186 visa is granted, you have full permanent residency rights and therefore have no enforceable obligation that prevents you from changing your employer or your role. However your employer has right and obligation to inform Immigration department about it and that can start further investigation.
If you visa is not granted yet, changing employer will mean new nomination and new application.
Yes, 186 visa it is permanent visa. Once granted, it allows the holder (and any family members included in the application) to: stay in Australia indefinitely.
457/482 visa holder employees must work in the occupation for which your business has nominated them. For example, if your business has nominated the employee as a Software Engineer, the employee must only work as, and perform duties of, a Software Engineer.
Once the 457/482 visa has been granted, an employee must start employment with the sponsor either within 90 days of arrival in Australia, or within 90 days of the grant of visa if they are already in Australia at the time of grant.
If the employee is already a 457/482 visa holder when approaching you, and was previously sponsored by another employer on this visa, the employee does not need another 457/482 visa but is only permitted to start employment with your business after the nomination for the relevant position within your business is approved.
- for visas granted before 19 November 2016 – maximum of 90 consecutive days
- for visas granted on or after 19 November 2016 – maximum of 60 consecutive days
If your occupation make you eligible under the short-term stream then maximum time period that your TSS visa will be approved for is two (2) years. If your occupation makes you eligible under the medium-term stream, then the maximum time period that your TSS visa will be approved for is four (4) years.
In certain cases, applicants may be restricted in the number of times they can renew a TSS visa whilst onshore. If you apply for a TSS visa under the short-term stream, you can renew your visa onshore once only (exceptions apply).
You will be eligible for PR when/if: You have worked for the same sponsor for three years on your TSS visa. You have worked in the same occupation for the three years. You are under 45 years of age at the time of lodging your permanent residency visa.
